At Albut Law we help people reduce or eliminate their debts through bankruptcy. We help them avoid foreclosure and keep their personal property. Our firm can eliminate tax debts and stop repossession, while lowering car payments. Through bankruptcy, you can discharge unsecured debt, such as medical debt, credit cards, and other loans or lines of personal credit in the form of payday and personal loans, and much more. Bankruptcy can also immediately halt wage garnishment if done in a timely manner.
We handle Chapter 7 and Chapter 13 bankruptcies for individuals.
Chapter 7 bankruptcy
Chapter 7 bankruptcy is an opportunity to discharge, with a few exceptions, all of your debts. This allows you a fresh start with a clean slate. Most of the debts that you have incurred will be dischargeable, but some are not — most notably student loans. However, Credit card debt, medical bills, and re-affirmation of your mortgages can allow you the chance to move ahead. Although bankruptcy stays on your credit record for 10 years, the good news is that you can start to re-establish credit in as little as three years.
Chapter 13 bankruptcy
In some circumstances, you may not qualify for complete discharge of your debts — you may make too much money or have too many assets. But the good news is that debt relief is still available. By filing Chapter 13 bankruptcy, you can participate in a court-supervised debt reorganization that allows you to make smaller payments, allows — in some instances — complete discharge of certain debts, and allows you to re-establish a good credit rating.
Whether you qualify for a complete discharge through Chapter 7, or a reorganization of your debt through Chapter 13, at the Law Office of Christian J. Albut, we will help you analyze your current financial situation, assess what options are available to you, and guide you to make the right decision for you now and for the future.
We also represent debtors and creditors in bankruptcy litigation (adversary proceedings).
